THE BLACK WALL — NEW RHETORIC RECEIPT

October 16, 2026 | Ohio Governor's Race

Finding: New Ohio appeals court ruling creates a significant legal obstacle for school-voucher policies.

New evidence: On October 15, 2026, Ohio's Tenth District Court of Appeals unanimously affirmed that the state's current EdChoice school-voucher programs violate the Ohio Constitution.

The case, Columbus City School District v. State, directly involves Columbus schools and has implications for education proposals in the governor's race.

1. Ramaswamy's original position

Speaker: Vivek Ramaswamy

Original recording: April 25, 2025

Platform: The Ohio Channel, The State of Ohio

Sponsor: Public-affairs interview, not identified as paid campaign advertising.

At approximately 13:41, Ramaswamy said:

> “That's why I support taking our school choice programs to the next level.”

He also acknowledged that some Ohio counties lack meaningful alternatives to public schools.

New legal context: The appeals court determined that Ohio's current voucher structure creates a competing publicly financed private-school system without equivalent public-school obligations.

The decision creates a significant obstacle to expanding that structure without addressing the constitutional problems identified by the court.

It does not establish that every possible voucher expansion would be unconstitutional.

2. Acton's original position

Speaker: Amy Acton

Original source: Official campaign education platform

Publication date: Not specified on the page; reviewed October 16, 2026.

Sponsor: Ohioans for Amy Acton and David Pepper.

Acton's campaign states:

“I will bring reform to our corrupt school voucher system”

Her platform also calls for implementing Ohio's Fair School Funding Plan.

New legal context: The court's decision supports the existence of serious constitutional problems with the current voucher system.

However, a finding of unconstitutionality is not a judicial finding of corruption. The ruling does not establish bribery, fraud or intentional misconduct by program administrators.

Acton's description of the program as corrupt therefore remains political characterization, not a conclusion established by this decision.

3. What the court actually established

The original judicial opinion identifies several material findings:

- Funding: EdChoice and EdChoice Expansion cost approximately $1.45 billion combined across fiscal years 2024 and 2025.

- Admissions: Participating private schools retain discretion over which students they admit.

- Oversight: The court found that participating schools face substantially different accountability obligations from public schools.

- Public-school finances: The court found that the voucher system undermines public-school funding through several interacting mechanisms.

The court also examined evidence that voucher expenditures and shortfalls in full public-school formula funding were comparable during fiscal years 2023 and 2024. It did not establish that eliminating vouchers would automatically redirect every dollar to public schools.

4. Important limitations

The voucher program has not been shut down.

The appeals court stayed enforcement of its judgment pending an anticipated further appeal.

The court also expressly limited its constitutional conclusion to EdChoice and EdChoice Expansion as currently structured and funded.

It did not decide the students' remaining equal-protection appeal or establish that the program violated racial-equality protections.

5. The Black Wall accountability questions

For Ramaswamy, the documented question is how further school-choice expansion would comply with the newly affirmed constitutional requirements.

For Acton, the documented question is what specific voucher reforms she would enact, what they would cost, and how she would protect families currently using the program.

For both, the measurable test remains whether their policies improve student achievement, educational access and funding equity.

Neither campaign's position establishes those future outcomes.

Receipt classification

NEW DOCUMENTED FINDING — LEGAL IMPLEMENTATION BARRIER AND MATERIAL POLICY CONTEXT.

The October 15 ruling materially changes the legal context in which the candidates' education proposals must be evaluated.

It does not establish that either candidate knowingly made a false statement.

Evidence status: Original campaign material, original recorded interview and complete appellate opinion reviewed. No finding concerning manipulated visuals or media authenticity.
